Legal Risks in Aviation Finance
Amna Al Jallaf, Managing Partner of Al Jallaf Advocates, participated as “Legal Risks in Aviation Finance” panel member and a keynote speaker in the Airline Economics: Growth Frontiers Dubai 2018 Event which was held on Wednesday, October 3rd 2018, and took place at the Ritz Carlton Dubai Beach Hotel.
Amna delivered a comprehensive overview of the Cape Town Convention & the Aircraft Protocol thereto, both ratified by the UAE on 29.04.2008 and entered into force on 01.08.2008. She mentioned that the principal objective of the Convention is to facilitate the efficient financing and leasing of mobile equipment. Such financing will assist in the development of cost-effective modes of transport and space assets utilizing modern technologies. The Convention system is designed to bring significant economic benefits to countries at all stages of economic development, and in particular to developing countries by bringing within their reach commercial finance for mobile equipment that has previously been unavailable or available only at relatively high cost.
Amna discussed the current situation in the UAE regarding the application of the Convention, and some recommended procedures to make full use of the same to be beneficial to the aviation stakeholders in the UAE.
She also delivered some proposed measures and solutions to mitigate the risks in Aviation Finance sector, by adopting the blockchain technology and smart contracts for managing such transactions.
